iNovioHomes Inc. Policies & Terms of Service

1. Contract & Order Formation

• All product details displayed online or shared via phone, email, or chat are invitations to buy, not binding offers.
  
• An order is created when payment is completed or when confirmed via phone, chat, or email. Errors must be reported within 24 hours.
  
• iNovio Homes Inc. may refuse or cancel orders for compliance, inventory, pricing, or technical reasons.
  
• A binding contract exists only once the products are shipped.
  
• If an order is canceled, the Customer will be notified and refunded per company policy.
  

2. General Provisions

2.1 Availability – Products listed online are invitations to treat and not guarantees of availability.

2.2 Product Specifications – All dimensions and weights are approximate; variations may occur.

2.3 Assembly Requirements – Some products require assembly; this is the Customer’s responsibility.

2.4 Colors – Product colors may vary slightly due to photography, displays, or manufacturing.

2.5 Ownership, Risk & Title

• Risk transfers upon delivery.
  
• Ownership transfers only after full payment is received.
  
• Until payment clears, goods remain iNovio Homes Inc. property.
  

2.6 Limitation of Liability – No liability for indirect losses (profit, time, business, etc.) except in cases of negligence causing injury/death.

2.7 Amendments – Terms may be updated anytime; the latest version on the website applies.

2.8 Waiver – Failure to enforce rights does not waive them.

2.9 Severability – Invalid provisions will be modified or removed without affecting the rest.

2.10 Assignment & Third Parties – Customer cannot transfer obligations without written consent.

2.11 Commercial Use – Products are for residential use unless otherwise authorized. Unauthorized commercial use voids warranty.

2.12 Entire Agreement – These Terms replace any prior agreements.

2.13 Governing Law – Texas law applies. Courts in Houston, Texas have exclusive jurisdiction.

2.14 Dispute Resolution – Disputes must first attempt amicable resolution via support@inoviohomes.com.

Unresolved matters go to binding arbitration in Houston, TX, except for intellectual property disputes.

3. Events Outside Our Control

No liability for delays or disruptions due to circumstances beyond reasonable control (e.g., natural disasters, strikes, epidemics, government restrictions).

4. Prices

• Prices exclude delivery unless stated otherwise.
  
• Sale prices apply only during promotion periods.
  

5. Payment

• Payments must be made via accepted methods listed on our website.
  
• Orders are subject to availability.
  
• If pricing errors occur, Customers may proceed at the correct price or cancel.
  
• Title passes only after delivery & cleared payment.
  

6. Permitting

• iNovio Homes Inc. does not secure permits, approvals, or HOA authorizations.
  
• Customers are responsible for ensuring compliance with all local regulations.
  

7. Risk-Free Orders (Hold & Confirm)

• Customers may reserve pricing for 14 days while approvals or final selections are pending.
  
• Cannot be used to delay delivery for unrelated reasons (e.g., construction delays, lack of storage).
  

8. Delivery Coordination

• Customers must ensure availability at the delivery address.
  
• Failure to receive may result in extra fees or rescheduling delays.
  

9. Warranty Coverage

• 10 Years – Structural elements (columns, beams, base plates).
  
• 5 Years – Mechanical components (louvers, cranks).
  
• 2 Years – Electrical components.
  

Warranty Notes

• Applies only to original purchaser in USA & Canada.
  
• Begins upon delivery.
  
• Non-transferable.
  
• Limited to replacement parts or refund up to purchase value.
  

Exclusions Include

• Natural disasters, misuse, neglect, improper installation, abnormal loads, fading, wear-and-tear, chemical damage, rust from condensation, or lack of maintenance.
  
• Installation delayed more than 12 months after purchase.
  
• Ancillary expenses (shipping, storage, installation labor, etc.).
  

Claims

• Must be submitted within 30 days of defect discovery.
  
• Include purchase invoice + photos + written claim to support@inoviohomes.com.
  

10. Liability

• iNovio Homes Inc. accepts responsibility only in cases of injury, gross negligence, or product liability.
  
• Liability for minor negligence is limited to foreseeable damages.
  

11. Product Damage Resolution

• Customers must check deliveries before installation.
  
• Damage from obvious defects at assembly is not covered.
  

12. Third-Party Installation

• Customers must verify all parts before arranging installation.
  
• iNovio Homes Inc. is not responsible for third-party installer delays or damages.
  

13. Shipping Policy

• Delivery Area – Continental U.S. only (Hawaii, Alaska, or international by agreement).
  
• Inspection – Customers must inspect products within 7 days of delivery.
  
• Accuracy of Information – Customers must provide complete and correct delivery details.
  
• Delivery Issues – For timely reported damages, iNovio Homes Inc. will coordinate repair/replacement.
  

14. Cancellation Policy

• Free Cancellation – Within 3 days of order.
  
• After 3 Days – 15% cancellation fee applies.
  
• Orders in Transit – Subject to restocking & recall fees.
  
• Custom Orders – Cannot be canceled after 3 business days.
  

15. Refund Policy

• Must report issues within 7 days of delivery.
  
• Full refund only if product unavailable or replacement not possible.
  
• Processing within 10 business days.
  
• Refunds subject to inspection & applicable fees.
  

16. Return Policy

• Returns within 30 days of delivery.
  
• Subject to 15% cancellation fee + shipping & restocking.
  
• Pergolas must be securely packaged/palletized for return.
  
• Customer bears all risk during return shipping.
  
• Accessories may be returned if Customer covers shipping.
  

17. Custom Orders Policy

• Full payment required before production.
  
• Cancellation only within 3 business days of order.
  
• After production starts, no changes allowed.
  

18. Tax Exemptions

• Customers must submit valid 501(c) documentation before purchase.
  
• Tax exemptions cannot be applied retroactively.
  

19. Final Provisions

These Terms constitute the entire agreement. Any issues not covered fall under Texas law.

20. Privacy Policy

• We collect personal, purchase, and device data for order processing, customer service, and compliance.
  
• Hosted securely on Shopify.
  
• Payment data is encrypted and deleted after processing (per PCI-DSS standards).
  
• Data may be shared only with trusted service providers, legal requests, or during business transitions.
  
• Cookies are used for site functionality; Customers can manage via browser.
  
• Customers may request access, correction, deletion, or portability of personal data.
